Depending on the charges, drug crimes, including drug possession, carry some of the most severe legal penalties. I represent clients in all types of drug charges including drug possession which can include all controlled substances such as marijuana, heroin, cocaine, morphine, ecstasy, methamphetamine, and LSD. To arrest you for possession of drugs, the government does not need to find the drugs in your hand, on your person, or in your exclusive possession. It’s enough if they can show that the drugs were in a place where you placed them or hid them.

Drug trafficking, in contrast, implies the large-scale transfer, sale, or distribution of controlled substances or drugs. Depending on the drug or illegal substance, you can be charged with Drug Trafficking for 10 pills or less. Because of the government’s “war on drugs,” the laws have been changed to impose Minimum Mandatory sentences on many drug offenses. 

Depending on the drug/controlled substance you have been charged with possessing or trafficking, the minimum mandatory sentence could range from 3 years and a fine of $50,000.00 up to 25 years and a fine of $500,000.00.

Any person sentenced to a minimum mandatory sentence is not eligible for any form of discretionary early release, gain time, or time off for good behavior. They must serve each day of the sentence unless pardoned by the governor.
