Domestic violence means any criminal offense resulting in physical injury or death of one family or household member by another family or household member. Those criminal offenses can include:

“Family or household member” means:

  • Persons who are parents of a child in common

Domestic violence can be a felony or misdemeanor depending on the act and the extent of the injuries. These cases are usually very sensitive cases involving a great degree of emotion because of the relationship between the parties involved. As a result of minimum mandatory sentencing and increased public and media attention, domestic violence cases need to be treated very carefully.

If you are arrested on a domestic violence charge, you will be taken to jail and will not be released until after appearing before a judge. You will spend at least one night in jail. The court will probably impose a “No Contact” order, which means that you are to have absolutely no contact with the alleged victim under any circumstances. You cannot go home if the alleged victim lives there. You cannot see your children or family if they live with the alleged victim or the alleged victim lives with them. You could be allowed a one-time return visit to the family home to get some of your personal belongings.

Many times the alleged victim will file a petition for a restraining order and other court ordered restrictions. The results of the restraining order can have effects on your life long after the Domestic Violence case has ended.

Having a domestic violence charge and a restraining order on your record can damage your reputation and ruin your life. Even if an individual has no criminal record whatsoever, a sentence in a domestic violence case (even if adjudication is withheld) cannot be removed from records or sealed with expungement. Therefore, we will look for ways to achieve dismissal of the charges or seek alternative resolutions.
